The preventive law approach in mediation law consulting is a strategic method aimed at resolving disputes between parties amicably and in a spirit of mutual goodwill before they escalate into larger legal problems and long court processes. In Turkey, Mediation Law No. 6325 on Mediation in Legal Disputes (HUAK) regulates both mandatory (as a prerequisite to litigation) and voluntary mediation. Voluntary mediation is the process where parties, without any legal obligation, voluntarily apply to a mediator to resolve their disputes. Through this approach, parties proactively eliminate problems while avoiding the financial burdens, long waiting times, and deepening of disputes that litigation would bring.

In terms of time and cost savings, compared to court proceedings that may last for years, mediation enables disputes to be resolved in very short periods such as 2-3 weeks and at lesser expense.

In terms of control and flexibility, the outcome of the process is decided by the parties themselves, not a judge. Parties can exit the win-lose logic and produce flexible and creative solutions suitable for the interests of both parties (win-win).
